§ 2 Scope of application
These General Terms and Conditions apply to all legal transactions between the user and a consumer.
§ 3 Conclusion of contract and storage of the contract text
The provisions of these General Terms and Conditions apply to orders which consumers conclude via the online shop of the website www.create-space.ch. The contract is concluded with the user. The contract is concluded with the user (see § 1). The presentation and description of the goods on the website of the model shop www.create-space.ch does not constitute a contract offer. By ordering a product by clicking on the button "order with costs" at the end of the ordering process, a consumer makes a binding offer to conclude a purchase contract. The contract is not concluded until the user sends an order confirmation by e-mail. The text of the contract is saved for orders. Consumers receive an e-mail with the order data. After conclusion of the contract, the order data can no longer be viewed online.
When booking a coaching package, the amount for the booked sessions is due immediately. The coaching sessions should be taken up within the specified time frame. The time frames are described in more detail in the description of the respective coaching package.
§ 4 Payment
The statutory value added tax and other price components are included in the prices shown. Shipping costs are not included in the displayed price and may be charged additionally. The following payment options are available to consumers:
- credit card
- bank transfer
§ 5 Delivery, delivery restrictions
Unless the description of a selected product explicitly states otherwise, delivery shall take place within 7 working days. In the case of payment via bank transfer or credit card, this period begins to run on the day after the payment order is issued.
§ 6 Transfer of risk
The risk of accidental deterioration or accidental loss of the goods shall remain with the user until the goods are handed over and shall not pass to the consumer until the goods are handed over.
§ 7 Retention of title
The user retains ownership of the goods until the purchase price has been received in full.
§ 8 Warranty
The statutory warranty regulations apply.
§ 9 Refund of unused coaching services from the booked coaching packages
There is no entitlement to reimbursement of coaching sessions not taken up, unless these cannot be taken up due to serious, prolonged illness or other circumstances which make it impossible to take up the coaching sessions. Appropriate proof must be provided here.
Cancellation Policy
For digital products that are immediately available for download after payment:
I expressly agree to the execution of the contract before the expiry of the withdrawal period. I have noted that the right of withdrawal expires at the beginning of the execution of the contract.
For all other products of the Online Shop of Creating Space the following applies:
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear declaration (e.g. a letter or e-mail sent by post).
To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of the revocation
If you withdraw from this contract, we must refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days of the day on which we received notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.
